CovertCaller Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CovertCaller, a service operated by 2amNexus LLC (“CovertCaller,” “we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms. If you do not agree, you must not use CovertCaller.

These Terms form a binding agreement between you and 2amNexus LLC. CovertCaller is intended for individual consumers communicating in their personal capacity. You may not use CovertCaller on behalf of an organization.

You must be at least 18 years old and legally able to enter a binding agreement to use CovertCaller. By using the service, you represent that you meet these requirements.

CovertCaller is a consumer privacy service that provides an individual subscriber with a protected telephone number and email alias for lawful personal communications. The service is designed to help you keep your personal contact information private while communicating with the people and organizations you choose to contact.

CovertCaller is intended for personal consumer use. Each subscriber controls a dedicated number, and each outgoing message is manually initiated by that subscriber. Communications are conversational and two-way. CovertCaller is not a mass-messaging platform and is not a general-purpose business telephone system. CovertCaller does not send marketing on behalf of subscribers and does not provide contact lists or lead-generation tools.

You are responsible for ensuring that you have a lawful basis to contact any recipient and for obtaining any consent legally required before contacting a person or recording a call. This includes consent to record voice calls or voicemails where applicable law requires it. CovertCaller is not responsible for obtaining consent on your behalf.

You must stop communicating with any recipient who asks you to stop. Continuing to contact someone after they have requested that you stop is a violation of these Terms.

CovertCaller is intended for personal consumer use. You may not use CovertCaller:

• On behalf of a business or organization.
• As a business phone system.
• For marketing or advertising.
• For lead generation.
• For cold outreach.
• For bulk or mass messaging.
• For automated or scheduled SMS.
• With purchased, rented, shared, or scraped contact lists.
• To send substantially identical messages to multiple unrelated recipients.
• For unlawful, fraudulent, deceptive, abusive, or harassing conduct.
• To evade carrier rules or enforcement.
• For emergency calling or 911.

CovertCaller may monitor traffic patterns and automatically analyze communications for the following purposes:

• Spam prevention and filtering.
• Fraud and abuse detection.
• Prohibited-content detection.
• Security and protection of the service.
• Compliance with legal, regulatory, and carrier obligations.
• Transcription and summarization of messages, calls, and voicemails.

Automated analysis does not compose, address, initiate, schedule, or send subscriber SMS messages. Outbound conversational messages are written and initiated by the subscriber. You consent to this monitoring and automated analysis as a condition of using the service.

We may restrict, suspend, or terminate accounts at any time, including when we detect:

• Violations of these Terms or our Acceptable Use and Messaging Policy.
• Abnormal or excessive usage that strains the service.
• Carrier complaints, messaging provider complaints, or deliverability problems.
• Activity that threatens the service, other users, or third parties.

We may take these actions without prior notice where we believe it is necessary to protect the service or comply with law.

Assigned phone numbers and email aliases remain controlled by CovertCaller. We may reclaim, replace, suspend, or deactivate protected numbers and aliases at any time, including for compliance, carrier, or operational reasons. You do not own the protected phone number or email alias assigned to your account.

Subscribers must replace their protected phone number at least every 12 months. Email-alias changes are optional. Number changes are subject to account standing, availability, security review, and compliance review.

Rotation may not be used to evade recipient blocks, opt-out requests, spam complaints, carrier filtering, account restrictions, usage limits, investigations, or enforcement actions. CovertCaller may deny a rotation request or suspend rotation privileges when misuse or attempted circumvention is suspected.

CovertCaller numbers must not be relied upon for emergency communications or 911 service. CovertCaller is not a replacement for emergency telephone service and may not support, route, or complete emergency calls. Do not use CovertCaller phone numbers in situations where you need to reach emergency services.

Service availability, phone-number inventory, message delivery, voicemail, email delivery, and carrier connectivity are not guaranteed. CovertCaller depends on third-party carriers, providers, and infrastructure that may experience outages, delays, or limitations outside our control. We do not guarantee that every message, call, or email will be delivered or received.
